NELLIS AIR FORCE BASE, Nev. -- Lieutenant Colonel Kevin J. DiFalco was sentenced September 24 following a two-week general court-martial trial by a military judge to twelve years six months of confinement, dismissal, total forfeitures of pay and allowances, and a reprimand.
DiFalco was found guilty of committing seventeen offenses in violation of six articles of the Uniform Code of Military Justice to include - sexual assault in violation of Article 120; sexual assault of a child in violation of Article 120b; indecent exposure in violation of Article 120c; perjury in violation of Article 131; conduct unbecoming an officer in violation of Article 133; indecent conduct and receiving child pornography in violation of Article 134. The offenses were committed in or near Las Vegas, Nevada, San Antonio, Texas, and Fort Collins, Colorado, against one victim. The Department of the Air Force Office of Special Trial Counsel preferred and referred these charges to a General Court-martial and served as lead counsel for the United States during trial.
