Justice File: Legal Office releases August courts-martial, UCMJ actions

Editor's note: Each month, the legal office publishes the results of actions under the Uniform Code of Military Justice (UCMJ) completed during the previous month. Specific individuals are not identified.

Article 15 Actions: During August 2010, Nellis and Creech commanders administered 13 non-judicial punishment actions under Article 15 of the UCMJ. The punishments imposed reflect the commander's determination of an appropriate punishment after considering the circumstances of the offense and the offender's record. A "suspended" punishment does not take effect unless the offender engages in additional misconduct or fails to satisfy the conditions of the suspension. The suspension period usually lasts for six months unless a lesser amount is specified.


Conflict of interest (post government employment AFI violation) - A lieutenant colonel received forfeiture of $1,500 and a reprimand.

Dereliction of duty - A technical sergeant received forfeiture of $410 pay and 45 days extra duty.

Drunk and disorderly - A technical sergeant received a suspended reduction to staff sergeant and a reprimand.

Failure to go - An airman first class received a reduction to airman basic, seven days extra duty and a reprimand.

Failure to go - An airman first class received a suspended punishment to airman, 45 days extra duty and a reprimand.

Failure to go (two offenses) - An airman basic received forfeiture of $300 pay per month for two months, restriction to Nellis Air Force Base for 45 days with 30 days suspended and 45 days extra duty.

False official statement - An airman first class received a suspended reduction to airman, 30 days extra duty and a reprimand.

Incapacitated for duty (alcohol) - An airman first class received a reduction to airman basic.

Incapacitated for duty (alcohol) - A staff sergeant received reduction to senior airman, 30 days extra duty and a reprimand.

Misuse of government travel card - A technical sergeant received a reduction to staff sergeant, 45 days extra duty and a reprimand.

Signing false official record - A senior airman received a suspended reduction to airman first class, suspended forfeiture of $961 pay, seven days extra duty and a reprimand.

Spice use - An airman received a reduction to airman basic and 30 days extra duty.

Wrongful use of Oxycodone - A senior airman received a reduction to airman.

1) Senior Airman David A. Hollingsworth, 99th Security Forces Squadron, was tried by general court-martial Aug. 12. He was found guilty of wrongful possession of child pornography and sentenced to a reduction to E-1, 12 months confinement, forfeiture of all pay and allowances and a bad conduct discharge.

2) Staff Sgt. Benjamin J. Johnson, 820th RED HORSE Squadron, was tried by special court-martial  Aug. 13. He was found guilty of wrongful use of anabolic steroids and sentenced to a reduction to airman basic, 45 days hard labor without confinement and forfeiture of $964 per month for two months.

3) Tech. Sgt. Carey E. Dvorak II, 547th Intelligence Squadron, was tried by general court-martial Aug. 17. He was found guilty of writing 58 bad checks and wrongful use of his military identification card and sentenced to a reduction to senior airman and four months confinement.

4) Senior Airman Matthew A. Pingel, 99th Air Base Wing, was tried by general court-martial Aug. 20. He was found guilty of conspiracy to wrongfully distribute the drug ecstasy and wrongful use, distribution and introduction of the drugs ecstasy, BZP, methamphetamine, Ketamine, and psilocybin mushrooms and sentenced to a reduction to airman basic, 34 months confinement, forfeiture of all pay and allowances and a dishonorable discharge.

5) Airman 1st Class Melissa A. Masucci, 99th Security Forces Squadron, was tried by special court-martial Aug. 30. She was found guilty of wrongful use and distribution of the drug ecstasy and sentenced to a reduction to airman basic, two months confinement and a bad conduct discharge.

6) Airman 1st Class Adrianne T. Hessler, 99th Medical Support Squadron, was tried by special court-martial Aug. 31. She was found guilty of wrongful use of the drugs ecstasy, Percocet, LSD, morphine sulfate, Lortab, and psilocybin mushrooms and wrongful distribution of methamphetamine and sentenced to a reduction to airman basic, four months confinement, forfeiture of $964 per month for four months and a bad conduct discharge.
