UCMJ actions Published Dec. 9, 2009 U.S. Air Force Warfare Center Legal Office NELLIS AIR FORCE BASE, Nev. -- Editor's note: Each month, the legal office publishes the results of action under the Uniform Code of Military Justice completed during the previous month. For courts-martial purposes, specific individuals can be identified because the proceeding is public record. Courts-Martial: On Nov. 12, Staff Sgt. Cristina M. Levalley, 99th Ground Combat Training Squadron, pled guilty at a special court-martial to wrongful appropriation. A military judge sentenced her to a reduction to the rank of airman basic, 60 days confinement, 60 days hard labor without confinement and restriction to the limits of Nellis for 60 days. The punishment was imposed by a judge sitting alone. The special court-martial forum was chosen by the member facing the charges. To reach a finding of guilty, the court must consider the plea introduced by the member and all of the evidence submitted. If there is a finding of guilt, the court will then consider the entire record of the member and any additional matters presented on his behalf to reach a fair and just punishment. Article 15 Actions: During November 2009, Nellis and Creech commanders administered seven nonjudicial punishment actions under Article 15 of the UCMJ. The punishments imposed reflect the commander's determination of an appropriate punishment after considering the circumstances of the offense and the offender's record. A "suspended" punishment does not take effect unless the offender engages in additional misconduct or fails to satisfy the conditions of the suspension. The suspension period usually lasts for six months unless otherwise noted. Nonjudicial punishment is not a matter of public record and specific individuals are not identified. Disrespect to a noncommissioned officer, resisting arrest and driving under the influence-- An airman received a reduction to the rank of airman basic, forfeiture of $250 pay, and restriction to the limits of Nellis Air Force Base, Nevada for 30 days. Driving under the influence-- A senior airman received a reduction to the rank of airman first class. Indecent exposure-- A senior airman received a suspended reduction to the rank of airman first class, forfeiture of $250 pay per month for two months, and a reprimand. Misuse of Government Travel Card-- An airman first class received a suspended reduction to the grade of airman, 30 days extra duty, and a reprimand. Disorderly conduct-- An airman first class received a reduction to rank of airman, and a reprimand. Failure to perform duties due to intoxication-- An airman first class received reduction to the grade of airman basic, suspended forfeiture of $466 pay per month for two months, 30 days extra duty, and a reprimand. Drunk and disorderly-- A senior airman received forfeiture of $200 pay, and a reprimand.
