UCMJ actions Published March 12, 2010 U.S. Air Force Warfare Center Legal Office NELLIS AIR FORCE BASE, Nev. -- Editor's note: Each month, the legal office publishes the results of action under the Uniform Code of Military Justice completed during the previous month. Specific individuals are not identified. Article 15 Actions: During February 2010, Nellis and Creech commanders administered 10 non-judicial punishment actions under Article 15 of the UCMJ. The punishments imposed reflect the commander's determination of an appropriate punishment after considering the circumstances of the offense and the offender's record. A "suspended" punishment does not take effect unless the offender engages in additional misconduct or fails to satisfy the conditions of the suspension. The suspension period usually lasts for six months unless a lesser amount is specified. Failure to go, Dereliction of Duty, and Underage Drinking - An airman basic received a forfeiture of $700 pay per month for two months, that portion of the forfeitures in excess of $500 pay per month for two months is suspended, 45 days restriction, and 45 days extra duty. Wrongful use of Marijuana - A senior airman received a reduction to the grade of airman basic and a reprimand. Underage drinking, Dereliction of duty, False official statement - An airman first class received a reduction to the grade of airman basic (suspended), forfeiture of $811 pay per month for two months, and 45 days extra duty. Failure to go - A senior airman received a reduction to the grade of airman basic, which is suspended until July 9, 2010, 30 days of extra duty, and a reprimand. Failure to go - An airman first class received a reduction to the grade of airman suspended through Aug. 22, 2010, 30 days extra duty, and a reprimand. Disrespect toward a superior commissioned officer (two offenses), Disrespect toward a superior NCO (four offenses) - A senior airman received a reduction to the grade of airman first class, which is suspended until Aug. 16, 2010, forfeiture of $500 pay, and a reprimand. Going from appointed place of duty - An airman first class received a reduction to the grade of airman. Dereliction of Duty - A senior airman received a forfeiture of $1,047 suspended through Aug. 21, 2010, and a reprimand. Misuse of Government Travel Card - A senior airman received a reduction to the grade of airman first class and a reprimand. Resisting Apprehension, Assault, Drunk and Disorderly, and Wrongful Communication - A staff sergeant received a reduction to the grade of senior airman and a reprimand.
