Justice File: Legal Office releases July UCMJ actions Published Aug. 9, 2010 U.S. Air Force Warfare Center Legal Office NELLIS AIR FORCE BASE, Nev. -- Editor's note: Each month, the legal office publishes the results of actions under the Uniform Code of Military Justice (UCMJ) completed during the previous month. Specific individuals are not identified. Article 15 Actions: During July 2010, Nellis and Creech commanders administered seven non-judicial punishment actions under Article 15 of the UCMJ. The punishments imposed reflect the commander's determination of an appropriate punishment after considering the circumstances of the offense and the offender's record. A "suspended" punishment does not take effect unless the offender engages in additional misconduct or fails to satisfy the conditions of the suspension. The suspension period usually lasts for six months unless a lesser amount is specified. Wrongful use marijuana - An airman first class received forfeiture of $100 pay per month for two months, 30 days extra duty and a reprimand. Making a false official statement - A senior airman received a reduction to the grade of airman with a suspended reduction to the grade of airman basic, 30 days extra duty and a reprimand. Driving under the influence, dereliction of duty - An airman first class received a reduction to the grade of airman with a suspended reduction to airman basic, 45 days extra duty and a reprimand. Failure to go, making a false official statement - A senior airman received a suspended reduction to airman basic, 30 days extra duty and a reprimand. Misuse of Government Travel Card - A senior airman received a reduction to airman basic, 30 days extra duty and a reprimand. Failure to go (two offenses), failure to obey lawful order, disrespect to an NCO - An airman first class received forfeiture of $852 pay, 15 days restriction and a reprimand. Striking an NCO, drunk and disorderly - A senior airman received a reduction to airman first class with a suspended reduction to airman, 45 days extra duty and a reprimand.
