Justice File: Legal Office releases September courts-martial, UCMJ actions

Editor's note: Each month, the legal office publishes the results of actions under the Uniform Code of Military Justice completed during the previous month. Specific individuals are not identified.

Article 15 Actions: During September 2010, Nellis and Creech commanders administered 13 non-judicial punishment actions under Article 15 of the UCMJ. The punishments imposed reflect the commander's determination of an appropriate punishment after considering the circumstances of the offense and the offender's record. A "suspended" punishment does not take effect unless the offender engages in additional misconduct or fails to satisfy the conditions of the suspension. The suspension period usually lasts for six months unless a lesser amount is specified.


Failure to obey
- An airman first class received a reduction to airman basic and 30 days restriction.

Sleeping on post - A senior airman received a reduction to airman first class, five days extra duty and a reprimand.

Failure to go - An airman first class received a suspended reduction to airman, 30 days extra duty and a reprimand.

Spice use, drunk on duty - An airman first class received suspended reduction to airman.*

Failure to go - A senior airman received a suspended reduction to airman first class, 45 days extra duty and reprimand.

Underage drinking, spice use - An airman received a reduction to airman basic, forfeiture of $723 pay and restriction to base for 30 days.*

Sleeping on post - An airman first class received a suspended reduction to airman, forfeiture of $100 pay per month for two months and a reprimand.

Spice use, failure to obey - An airman first class received a reduction to airman basic, forfeiture of $723 pay and restriction to base for 30 days.*

Spice use - An airman first class received a reduction to airman basic, forfeiture of $723 pay and restriction to base for 30 days.*

Driving under the influence - An airman first class received a reduction to airman and reprimand.

Underage drinking - An airman first class received a suspended reduction to airman and a reprimand.

Dereliction of duty - A staff sergeant received a reduction to senior airman and reprimand.

Failure to obey
- A senior airman received a suspended reduction to airman first class, suspended forfeiture of $961 pay per month for two months and a reprimand.

*All individuals receiving Article 15s for Spice use have administrative discharge proceedings initiated against them for drug use.

1) Airman Yolanda High, 99th Medical Support Squadron, was tried by general court-martial Sept. 27. She was found guilty of wrongful use of cocaine and wrongful distribution of the drugs Percocet, Lortab and Morphine Sulfate, and sentenced to reduction to airman basic, confinement for 24 months and a dishonorable discharge.

2) Airman Brittany Groteguth, 99th Security Forces Squadron, was tried by special court-martial Sept. 30. She was found guilty of underage drinking and wrongful use of cocaine, and sentenced to reduction to airman basic, forfeiture of $500 pay per month for six months, hard labor without confinement for 45 days and restriction to base for 90 days.
